Welcome to Cozy Oven Co ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, services, and the purchase of fresh baked goods and related products from our online store.

By accessing our website or purchasing products from Cozy Oven Co, you agree to be bound by these Terms, as well as our Refund Policy and Privacy Policy. Please read them carefully before completing any transaction.

1. GENERAL CONDITIONS & ELIGIBILITY

Age Requirement: By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence.
Service Refusal: We reserve the right to refuse service, terminate accounts, or cancel orders for any reason at our sole discretion, including suspected fraud or breach of these Terms.
Platform Provider: Our store is hosted on Shopify Inc., which provides the online e-commerce platform allowing us to sell our products to you.

2. FOOD SAFETY, INGREDIENTS & ALLERGEN DISCLAIMER

Artisanal Baking: All our items are prepared fresh to order using artisanal methods. Minor cosmetic variations in size, color, shape, or texture are inherent to small-batch baking and do not constitute defective products.
Allergen Notice: Our baked goods are prepared in a kitchen facility that handles common food allergens, including but not limited to wheat, milk, eggs, tree nuts, peanuts, soy, and sesame. Cross-contamination is possible.
Severe Allergies: If you have severe or life-threatening food allergies, please exercise extreme caution. Cozy Oven Co assumes no responsibility or liability for adverse allergic reactions.
Storage and Handling: Customers are responsible for properly storing, handling, and consuming perishable items upon receipt or pickup. Cozy Oven Co is not liable for spoilage, mold, or quality degradation caused by improper storage after delivery or pickup.

3. ORDERING, CANCELLATION & MODIFICATION

Fresh Preparation: Because our products are perishable and baked fresh to order, production begins shortly after an order is placed.
Standard Order Changes: You may request to cancel or modify an order up to 48 hours prior to your scheduled shipping or local pickup date by contacting cozyovenhq@gmail.com.
Late Cancellations: Requests submitted within 48 hours of scheduled shipping or pickup cannot be accommodated, and no refunds will be issued.
Custom & Bulk Orders: Custom orders require a minimum of 7 days advance notice for cancellation. Deposits on custom orders are non-refundable once ingredient sourcing or preparation has commenced.

4. LOCAL PICKUP & LOCAL DELIVERY

Local Pickup Window: If you select local pickup at checkout, your order must be picked up during your designated time slot. Orders not claimed within 24 hours of the scheduled pickup time will be discarded due to freshness standards and will not be refunded or replaced.
Local Delivery: You are responsible for ensuring someone is available to receive local deliveries during the designated window or providing clear access instructions (e.g., gate codes, porch drop-off points). Cozy Oven Co is not responsible for stolen, damaged, or spoiled packages resulting from unresponsiveness or lack of access at the delivery address.

5. NATIONWIDE SHIPPING & CARRIER DELAYS

Shipping Address Accuracy: Customers are solely responsible for ensuring that all shipping details (street address, apartment/suite number, zip code) are correct at checkout. We are not liable for delayed, lost, or spoiled shipments caused by inaccurate delivery addresses.
Transit & Delays: Once a package is handed over to a shipping carrier (e.g., UPS, FedEx, USPS), delivery timelines are determined by the carrier. Cozy Oven Co is not responsible for transit delays caused by severe weather, carrier volume, incorrect addresses, or recipient unavailability.

6. PRICING, ACCURACY & PRODUCT AVAILABILITY

Prices: All prices listed on our website are in USD and are subject to change without prior notice.
Availability: Products are subject to inventory availability and seasonal ingredient access. We reserve the right to limit sales quantities or discontinue products at any time.
Pricing Errors: In the event that a product is listed at an incorrect price due to a typographical or system error, we reserve the right to cancel or refuse any orders placed for that product, regardless of order confirmation status.

7. INTELLECTUAL PROPERTY

All content on this website—including business names, logos, recipe names, product descriptions, website text, photography, graphics, and branding—is the property of Cozy Oven Co and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or use any content without prior written permission from Cozy Oven Co.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Cozy Oven Co, its owners, employees, and affiliates shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from:

The consumption or handling of our products.
Alleged allergic reactions or unexpected health reactions.
The use or inability to use our website or services.
Unforeseen carrier shipping delays or lost transit items.

In all circumstances, Cozy Oven Co's total maximum aggregate liability to you for any claim arising out of or related to an order shall not exceed the total dollar amount paid by you for that specific order.

9. GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you services or products shall be governed by and construed in accordance with the laws of the state and jurisdiction in which Cozy Oven Co operates, without regard to its conflict of law principles.
